Not playing devil's advocate, but if you're going to put a bench outside a football stadium, you might want to make it out of something that isn't going to react adversely with its environment and unable to be used on a regular basis. Third degree burns are VERY serious, with the flesh literally cooked to the bone. That bench had to be nearly 300 degrees or more to do that. I've never observed black polished marble get that hot in the sun. I'm guessing she also had on some sort of synthetic fiber pants that melted into her skin, compounding the problem, much like the flammable childrens' pajama thing from the 80's.

You make a good point.  Those who have lived in Texas SHOULD know that any dark surface gets very dang hot in the sun.  That's also a good reason to consider the materials for things like benches.  Just think about the size of the heat sink and reservoir of solar energy that a slab of black rock would hold.

Normal human reflex is get away from the heart source.  Granted, black marble is not the smartest choice for seating material in Texas either.  If I had to make a guess here I would be willing to wager that "adult beverages" had numbed this woman's reflexes a bit :rolleyes:  Why else would she sit on something that hot for that long?

All good points, just keep in mind this would assume that she really did suffer third degree burns. Could the granite even get that hot? Even if it could, wouldn't even a passed-out drunk react if it got that hot? Color me skeptical.

Texas has a 51% bar, a plaintiff found 51% or more at fault can't recover anything even if the defendant is found partially at fault. In their defense, seems to me the Cowboys could probably come up with hundreds of people who sat on the same bench in the hot sun and didn't get burned at all.
