I was quite sure it is a factor with Trade names. Like I could open a hardware store called McDonalds (especially if my name was McDonald) and be OK because I am not trying to compete with the burger chain and not causing confusion because it is a completely different sector (McDs would sue anyway, as they have in the past in exactly this situation, but assuming equal lawyers, they'd lose). Intent isn't required but makes for a stronger case.   US and Canadian IP law is surprisingly very different tho.

Interesting that RD Artist isn't registered and neither is the body shape.
